Public Hearing

Regarding Ed James Property - Annexation and Annexation Agreement – (SE Corner of Veterans Parkway and Frontage Road)

The Annexation process requires a Public Hearing.  Ordinances 22-015, 22-016 and 22-017 are all related to the Annexation.  The Applicant, Michael Martin, represents the owners.  The subject property consists of approximately 5.6 acres.  The existing site conditions and land uses are a gravel parking lot, nonconforming setbacks, outdoor storage of trucks/trailers, automobiles, and automobile parts.  The proposed Annexation Agreement would allow the existing uses to remain until December 31, 2033 or until the property is sold or developed, whichever occurs sooner.  When a piece of property is annexed into the Village, it comes in at the least dense zoning (Estate Residential).  Therefore, the agreement will need to be approved, the property will need to be annexed and rezoned to I-1 Limited Industrial along with Special Use Permit for Planned Development all set forth later in the agenda.

2022 State Champions – Class 4A

Brooks Middle School - 7th and 8th Grade Boys Basketball

The Brooks Middle School Boys Basketball teams for both the 7th Grade and 8th Grade recently won the Class 4A IESA State Championship for Middle Schools in their respective grade levels.  As Brooks Principal Dr. Keith Wood noted in his comments, this achievement of winning State Championship by two teams from the same Middle School and in the same year has been accomplished only four times in the history of this competition since its inception in 1985. The student athletes were presented with an acknowledgement of their historic achievement.

 

Approval of Bills

Trustees voted to approve bills in the amount of $2,819,200.80.    

 

Resolutions 

Approval of Resolution (22R-012) Approving Purchase of a  Ford Escape Hybrid Vehicle Through the Suburban Purchasing Cooperative Contract #206 for Building Department

Trustees voted to approve the purchase of a replacement vehicle.  This vehicle is part of the replacement schedule and will replace Unit 112, a 2009 Chevy Malibu, which is no longer repairable. The purchase is from Currie Motors-Frankfort as part of the State Government pricing.  The vehicle will be used by the Community Development Director and Planner.

This was a budgeted item and the total cost is $25,693.00.

The Public Services and Development Committee reviewed and recommended approval.

Approval of Resolution (22R-013) Approving Grant of a Public Utility Easement on Part of Lot 23 of Block 2 in Bolingbrook Subdivision Unit 2

Trustees voted to approve granting of this easement, which is needed in order to install a new Water Main as part of the Water Main replacement program in the Westbury subdivision.  This is to finish the areas north of Briarcliff Road.  The easement will be 20 feet wide with 1,652 square feet of area.

The Public Services and Development Committee reviewed and recommended approval.

 

Approval of Resolution (22R-014) Approving Recapture Agreement between the Village and the Pulte Home Company, LLC

Trustees voted to approve the agreement with Pulte.  Pulte Homes oversized and deepened a sanitary sewer that runs through Liberty Green Subdivision for the benefit of 9 properties located north of Liberty Green.  The amount of the recapture is $147,400 plus 5% interest and the Village will receive a 5% collection fee.  The agreement expires in 10 years.

The Public Services and Development Committee reviewed and recommended approval.

Approval of Resolution (22R-015) for Maintenance of Streets and Highways by the Village of Bolingbrook Under the Illinois Highway Code with the Illinois Department of Transportation

Trustees voted to approve the resolution which outlines the planned amount for the upcoming budget year for the maintenance of streets and highways by the Village under the Illinois Highway code.  This obligates our MFT (Motor Fuel Tax) allotment and will allow IDOT to begin reviewing individual bid packages. The contractual work will include sidewalks, striping, resurfacing, crackfilling, and the Woodcreek culvert replacement.

The Public Services and Development Department work will include snow and ice removal; drainage and pavement maintenance; sign and electrical maintenance; and tree maintenance.

The preliminary MFT amount budgeted is not to exceed $7,422,400.00.

Ordinances

Approval of Ordinance (22-015) Approving Annexation Agreement – Chicago Title Land Trust Company, as Trustee and as Successor to North Star Trust Company, Successor to Harris Bank, Successor to First National Bank of Joliet, Under a Trust Agreement Dated October 21, 1979 and Known as Trust Number 1689, and Midland States Bank, As Trustee Under the Trust Agreement Dated December 18, 2012 and Known as Trust Number 1901 (Hereinafter “Ed James Property” (SE Corner of Veterans Parkway and Frontage Road)

Trustees voted to approve the annexation agreement.  The property owner is seeking approval of an Annexation Agreement for the Ed James Property, which includes the rezoning to I-1 Limited Industrial along with a Special Use Permit for a Planned Development to allow the existing site conditions and land uses, to continue until December 31, 2033. The Ordinance also memorializes the dismissal of all pending litigation regarding the subject properties and execution of documents thereto.

 

Approval of Ordinance (22-016) Annexing Certain Territory to the Village for the Ed James Property

Trustees voted to approve the annexation of the Ed James Property.  Pursuant to the Annexation Agreement above, this Ordinance approves the annexation of the property, located at the Southeast corner of Veterans Parkway and W. South Frontage Road and commonly known as the Ed James Property.

 

Acceptance of Plan Commission Report PC 22-02 and Approval of Ordinance (22-017) Approving Rezoning and Special Use for Planned Industrial Development (SE Corner of Veterans Parkway and Frontage Road/Chicago Title Land Trust Company, as Trustee and as Successor to North Star Trust Company, Successor to Harris Bank, Successor to First National Bank of Joliet, Under a Trust Agreement Dated October 21, 1979 and Known as Trust Number 1689, and Midland States Bank, As Trustee Under the Trust Agreement Dated December 18, 2012 and Known as Trust Number 1901 (Hereinafter,  “Ed James Property”)

Trustees voted to accept the Plan Commission report and approve the accompanying Ordinance.  The applicant is seeking approval of a rezoning pursuant to the Annexation Agreement and annexation of the Ed James property from E-R Estate Residence to I-1 Limited Industrial.  In addition, the applicant is seeking approval of a Special Use Permit to allow the existing site conditions (e.g. gravel parking lot, non-conforming setbacks, etc.) and land uses, including outdoor storage of trucks/trailers, automobiles and automobile parts, to continue until December 31, 2033 or until the properties are sold or developed, whichever occurs sooner. The Village agrees that the owners shall need no further permits from the Village to construct, and the owners agree to install at the owners cost, an 8 foot stockade fence before December 31, 2022.  There is no development plan in place for the site at this time.

 

Approval of Ordinance (22-018) Approving an Agreement for the Use of the Public Way and Telecommunication Service Provider Fees Between the Village of Bolingbrook and Everstream GLC Holding Company LLC

Trustees voted to approve an agreement with Everstream to install its fiber optic cable and equipment under the public way.  Everstream will pay the Village 6% of its gross charge for services on an annual basis.
